Public Offer Agreement

The Ops VPN service is operated by the following legal entity (referred to as the “Service Provider”):

  A company duly registered in the Republic of Panama.

The Service is managed and provided through the official website opsvpn.com and its mirror domains.

2.1. Offer— this public offer containing all material terms of the agreement and expressing the Service Provider’s intent to conclude an agreement with any person who accepts it.

2.2. Acceptance of the Offer — full and unconditional acceptance of the Offer by the Customer through actions specified herein, including payment for the Services.

2.3. Customer — a legally capable individual, sole proprietor, or legal entity that has accepted this Offer and fulfilled payment obligations.

2.4. Agreement — this Public Offer Agreement concluded electronically upon Acceptance of the Offer.

2.5. Website — the official Ops VPN website: opsvpn.com and its mirror domains, through which the Service is managed.

2.6. Services — services providing access to VPN / proxy technologies, including the issuance of private access keys and ready-made configurations for proxy servers, the description, scope, duration, and pricing of which are published on the Website.

2.7. The specific conditions of the Services selected by the Customer form an integral part of this Agreement.

3.1. The Service Provider undertakes to provide the Services selected by the Customer.

3.2. The Customer undertakes to pay for the Services in accordance with the terms of this Agreement.

4.1. Full prepayment (100%) for the selected Services constitutes proper and unconditional Acceptance of this Offer.

4.2. The cost of the Services, available payment methods, and additional options are published exclusively on the Website.

4.3. By placing an order and/or making a payment, the Customer confirms full and unconditional acceptance of this Offer and all applicable Service conditions in force at the time of payment.

5.1. Customer Obligations

The Customer undertakes to:

• pay for the Services in full prior to their provision;
• provide accurate, complete, and lawful information required for the provision of the Services;
• independently monitor updates to this Offer and Service conditions published on the Website;
• refrain from copying, distributing, or otherwise using any intellectual property obtained in connection with the Services without the Service Provider’s consent.

5.2. Customer Rights

The Customer has the right to receive the paid Services in accordance with this Agreement.

5.3. Service Provider Obligations

The Service Provider undertakes to provide the selected Services with reasonable quality and in accordance with their description.

5.4. Service Provider Rights

The Service Provider has the right to:

• refuse service if Customer data is inaccurate or inconsistent;
• independently determine technical methods of service provision;
• modify the description or conditions of the Services with prior notification published on the Website.

6.1. The Customer bears full responsibility for violations of this Agreement and compensates the Service Provider for any losses caused.

6.2. The Customer is solely responsible for the accuracy of the information provided and bears all risks related to outdated or incorrect data.

6.3. Neither Party shall be liable for failure to perform obligations due to force majeure circumstances beyond reasonable control. If such circumstances last more than 30 (thirty) days, either Party may terminate the Agreement unilaterally.

6.4. The Customer may refuse the Services and request a refund no later than seven (7) days before the start of Service provision.

6.5. In other cases of refusal, the Service Provider may deduct actually incurred expenses.

7.1. Claims must be submitted electronically and are subject to mandatory review.

7.2. If a claim is deemed justified, the Service Provider may offer one of the following remedies:

• rescheduling of the Service;
• provision of an equivalent Service;
• discount;
• refund of prepaid funds.

7.3. All disputes shall be resolved through negotiations. If no agreement is reached, disputes shall be resolved in court at the location of the Service Provider under applicable law. Compliance with the pre-trial claim procedure is mandatory.

8.1. By accepting this Offer, the Customer consents to the collection, storage, and processing of personal data in accordance with:

• the California Consumer Privacy Act (CCPA) and the California Online Privacy Protection Act (CalOPPA), United States;
• applicable U.S. federal and state laws and international data protection standards;
• the Ops VPN Privacy Policy.

9.1. This Agreement enters into force upon Acceptance and remains valid for the duration of the Services or until terminated.

9.2. The Customer may terminate the Agreement by submitting a written notice no later than seven (7) days before Service commencement.

10.1. All communications and claims shall be sent via technical support on the official website: opsvpn.com.

10.2. Electronic correspondence is recognized as legally binding.

10.3. Simple electronic signatures (email addresses, website accounts) are deemed equivalent to handwritten signatures.
